The Finance Act 2023, assented to by the President of Kenya on 26 June 2023, introduced a Digital Assets Tax (DAT) through an amendment to the Income Tax Act, effective 1 September 2023. This new tax, detailed in section 12F and paragraph 13, Head B of the third schedule of the Income Tax Act, imposes a 3% levy on the gross fair market value of digital assets at the point of exchange or transfer.
