The inclusion of Kenya on the FATF grey list underscores significant concerns regarding anti-money laundering (AML) measures, particularly in the realm of virtual assets. The Financial Reporting Centre's 2023 risk report highlights vulnerabilities and risks associated with the burgeoning virtual asset sector, including potential misuse for illicit activities. This roundtable aims to address the specific AML issues tied to virtual assets, examining regulatory gaps, the effectiveness of current oversight mechanisms, and the impact on the private sector. Stakeholders will discuss strategies to strengthen AML compliance, enhance transparency, and mitigate risks in the virtual asset ecosystem to ensure alignment with international standards.

DIGITAL ASSET TAX ROUNDTABLE

Events

The Finance Act 2023, assented to by the President of Kenya on 26 June 2023, introduced a Digital Assets Tax (DAT) through an amendment to the Income Tax Act, effective 1 September 2023. This new tax, detailed in section 12F and paragraph 13, Head B of the third schedule of the Income Tax Act, imposes a 3% levy on the gross fair market value of digital assets at the point of exchange or transfer. The upcoming roundtable aims to discuss the implications and concerns of this tax from the private sector's perspective, with a view to proposing amendments or its complete removal.
